I am the Chairman, Alderman John Tramontozzi. And with us is the Vice Chairman Alderman Francis Wright. Also voting members, Alderman Peter Mortimer and Alderman Michael Zwirko. And of course, President, ex-officio member, President of the Board, Donald Kahn Jr. voting members this evening present with us alderman Boisselle alderman inferno and alderman

Tramontozzi: mary beth magatir margolis uh do we have uh just for the record the uh this meeting is being recorded pursuant to uh the massachusetts open meeting law and is available for viewing and i think i mentioned everybody so is there uh so moved motion to open the floor for public Public participation. We have with us this evening, anybody members of the public who wish to come forward to speak on. We have one order on the agenda this evening, and we have a member of the public who wishes to be here and speak. Please identify yourself and make a note on the paper before you, you name it.

▶ 23:00 Thank you. My name is Jeremy Rose. I reside at 62 Mount Vernon Street. A month ago when you last had some discussion about this order, I was disappointed that rather than expanding the role of citizens on the committee from what the presentation of the order was, people were talking about about going less and somebody else talked about leaving the treasurer on the committee when that's not necessarily what's what's implied now one of the things that I see in the city is that most of the committees in the city are comprised of citizens not of employees and staff of the city when when people were making policy recommendations to the board you want them to come from a broad range of perspectives not everybody who's just

▶ 23:59 embedded in the city telling you what the city you know in kind of a closed arena decides that they want to do you know I fear that in part the whole we've gotten into in the water and sewer infrastructure has been due to the fact that we haven't had outside people on the water and sewer committee all over the state all over the country people have citizen members of water and sewer committees and there's often plumbers on there and and a whole range of people who do economic analysis and things like that here we don't have that um and so i would urge this board and i i sent to you i don't did all of you get um something i emailed to the board some did not some didn't okay anyway i emailed a

▶ 24:44 um a letter and i'll i can give you copies if you don't have them um stating some of the reasons why i think that instead of having a six-member board as you have now with five members who essentially work for the mayor and one member who's from the board of aldermen i would suggest that we're better off having a five-member board three citizens ordinary citizens on the committee and the city engineer and one member of the board of aldermen as you have today there are many reasons for that the the city engineer can certainly well represent the position of the department Department of Public Works right now you have three people in the Department of Public Works on the committee the city engineer the director and one of the staff people working in the water

▶ 25:36 department as you know the building office so clearly one person can replace those three and we don't have to take the time and energies of the the staff person or of the director of public works with plenty of other things to do than than sit in the meeting talking about water and sewer issues um at the same time right now we have the city auditor and the city treasurer on the on the committee and you know the purpose of them you might certainly say you might want information from them from time to time for them to submit information but i would suggest that just as you do with the board of aldermen and you request information from employees of the city to present to you here the water and sewer committee if they need information from

▶ 26:18 the auditor or from the treasurer they can certainly make a request and it can be submitted in writing or if they need to appear at a meeting and have a a short presentation that would be possible too i do want to emphasize though that that there is a real good reason for having citizens on this board and for having it as a majority of citizens because if it's a majority of citizens on the board the citizens basically can help determine the direction of where we go with water and sewer the citizens are the rate payers they are the ones who are affected and obviously everybody has their own little niche and we need people who are broad minded and can think about all the different types of rate payers even when they're there but we don't we personally i

▶ 27:00 don't think we've seen that representation on the water and sewer committee for the years that i've been paying attention to it I think that just for committee work in general and committees that I established and I put together with other people as just a partner we try to bring together people who have varying perspectives we aren't looking for a unanimous agreement on things we want to bring the varying tensions into the room to figure out how they play out what's important what's not important is this more important than that or is this cost higher than that that that reward um to have unanimous agreement as we typically do with a six to nothing vote on a water and sewer committee at some level some people who who work in this field would say or who work in the field

▶ 27:57 of of committee process would say that that's not an effective committee if there's no ever not ever any disagreement if there's always full agreement somebody's not pushing hard enough to find that that balance point of what's the best you can do where it meets people's um you know almost sense of awkwardness a sense of worry um i do want to emphasize that we are the leakiest sewer system in the mwra district i haven't seen the latest figures but we were a year ago right we got to that point because we didn't have forward-looking people having a policy impact on what we did with our water and sewer system and that was a failure over decades the current water and sewer committee isn't that old but over the decades we always had the city

▶ 28:47 government emphasis in making decisions and we've continued that for the last five or six years as well and it hasn't served us well some of you might argue that well now the city is acknowledging that with a leakiest system in the in the state and you're they're acknowledging that there's some inequities in the system and that maybe this whole rate tiered structure wasn't absolutely necessary as they claimed before the there's several issues about that that even if they have this newfound awareness of something clearly the fact that they had to be presented to people for them to come around over a period of years to understand something shows that they don't innately get it right there's a there's a

▶ 29:33 political process here you're looking puzzled there you know if you might not know something and then I tell you something you think oh I know what I don't need you to tell me any more about it well clearly if you don't understand the basis of something and you go in one direction ignoring the basis and then somebody gives you the the you know the calculated result to say you know yeah you have the calculated result but without knowing everything that went into it how do you incorporate in other decisions those same those same premises that are involved in that it's this isn't a simple looking at water and sewer issues is not a simple thing there are a lot of competing positions competing resources for competing things and you have to balance a lot of issues

▶ 30:17 around the city how much money you can you can actually get from the rate payers versus what you need to do with it you know if you're going to have money what's the biggest bang for the buck and how do you invest it and this board certainly isn't expected to have the expertise of looking into those or the time to look into those in depth you have plenty of other issues in the city to do I would suggest that some some citizens can bring some some expertise and some attention and research to these issues that could present a very different picture than what you've seen in the years in the last few years in one point that I want to make it it's certainly my personal opinion but the The fact that we're sitting with hundreds and hundreds and hundreds of thousands of

▶ 31:06 dollars sitting in reserve accounts or sitting as free cash and not working to make our system less leaky on the sewer side and even less leaky on the water side means that somebody's not paying attention. The fact that we're willing to invest the free money or the very low interest money MWRA gives us doesn't to me telegraph or signal that the people in the city who are pushing the issues understand the real hole that we're in. We need to make the investment with the money we have and frankly to bond some more money to get a handle on our water and sewer issues for generations to come. And as I've been saying the last four or five years here at this board is the sooner we do this work, because of the way that the MWRA sewer rates are established, the sooner we do this work

▶ 32:04 ahead of, if you will, the other cities and towns in the MWRA district, if we get ahead of them, we have a benefit. If we only use our proportionate amount of money from the MWRA going forward, as they do, we can save all the sewerage in the world. It's not going to save us any money because everybody else is reducing commensurately i raise this issue because even today the the position of the city-led water and sewer committee is such that we need to keep all this hundreds and hundreds of more than a million dollars sitting doing nothing for the water and sewer enterprise fund the rate payers have paid the money it ought to be invested in the fund for the rate payers and none of the city leaders who are on that water and sewer committee are getting that message they aren't

▶ 32:54 hearing that the money ought to be working for us not sitting in a bank looking pretty it doesn't help anybody there um in short you know i know alderman khan proposed two people on this board and there was some discussion last time about you know well you know different things um but again i i stand by my proposal that three citizen members a board of alderman member and a city employee member who i think would be natural for the city engineer given that the city engineer is a person that attends the mwra board meetings and advisory board meetings that person would bring the most to bear to a to a committee like that it's important also i want to be clear that we don't all we don't all on all the committees in the city we don't have staff or board of alderman on typically but it

▶ 33:50 is a good idea to have a staff person there i believe the the dpw city engineer there because it's good to have an institutional representative somebody who has the capability of scheduling meetings keeping minutes making certain that communications go out getting the documentation that might be needed from the dpw or from somewhere else to in hand that would be a valuable resource i think on the committee so i would certainly want to keep a dpw person on there but again you know planning board zoning board mellows commission on women all these things don't have aren't loaded up with with primarily city staff and nor should they be and i would think that for parity and essentially parity purposes as well as good public policy purposes

▶ 34:35 i believe this board ought to increase what alderman presented as two citizen members and make it three i don't think what one of the aldermen suggested about the city treasurer staying on the board is important because frankly the the work of the city treasurer is really not is tangential to what happens at the water and sewer committee the city auditor might have information but certainly city auditors information is what's required not his position as a um you know if you will as a um a person close to the mayor to push the mayor's perspective the mayor has that opportunity through the dpw director through the city engineer if he wants some policy representative that meeting otherwise so um you know it's important number one that

▶ 35:24 we have good safe sanitary water and sanitary sewer system it's also important that we look at what the costs of service are to supply that to all of our residents and businesses and city municipal uses and that we find a fair method of apportioning the costs based on the cost of service to the various elements in the city i don't see that this has been effectively accomplished with the current makeup of the board certainly which is why i thank alderman khan for his for his order here i think i would certainly like to see one step further and let the citizens be in control the rate payers be in control of recommending to you you have the final say obviously right let the citizens have more say about what's recommended to you and why because

▶ 36:19 the city staff the mayor already has a large amount of power in presenting what he wants to and these other perspectives these other other elements are what haven't been coming to the surface except what somebody can come here and speak about in 10 minutes one time Anyway, as always, thank you for your thoughtful consideration of my comments today. Especially if you disagree with me, you may make a decision tonight, but especially if you disagree with me, I'd like you to let me know and I'd like to know why. The materials I give you, the things that I say, I put a lot of thought and effort and I'd like to be sure that there's not some misunderstanding that something that I'm intending to tell you or inform you about you somehow misinterpret please you know provide me the

▶ 37:09 courtesy of letting me respond if you disagree with me in some way let's have a discussion about it it's okay we can disagree in some parts i in closing i'd like to say i would like to see more disagreement at more of our committee meetings at more of our board of alderman meetings because when you see disagreement you know that you're making progress that's then probably at the extent that you need to make progress not just going and taking little baby steps and so everybody's getting comfortable with it we need a little bit of discomfort in the city we need people to push the the envelope a little bit especially in the water and sewer system because it's so embarrassing that we are so bad as being the worst in the nwra in our sewer system so thank

Tramontozzi: you very much for your consideration and i look forward to listening to your comments thank you very good thank you is there any other members of the public who wish to come forward and speak on this order seeing none motion to close public participation second we have a motion to close public participation by alderman mortimer seconded by alderman Boisselle on the motion all in favor you can't second it oh second that's right you're not you're a non-voting member right we have a second by alderman's work who is avoiding the voting number thank you all in favor aye any opposing none so I'm gonna read let me just read into the record the order so we have one order and that's order number 2017 dash 82 to

▶ 38:36 John N. Tramontozzi: amend the Melrose revised ordinances chapter 228 section 228 dash 15 B water rate review committee as set forth here in this order is sponsored by president of the Board of Aldermen, Donald Kahn. Let me read it. It says, Be it ordained by the Mayoral's Board of Aldermen that Section 228.15 be amended to provide. There is hereby created a Water Rate Review Committee to consist of the Director of Public Works, the City Auditor, an Alderman Appointment by the President of the Board of Aldermen, and two citizens Appointment by the President of the Board of Aldermen. The Committee shall meet at least quarterly ready to review the water rates established pursuant to this section, the cost of operating the water system, and any capital improvements to the system.

▶ 39:22 It shall report its findings and any recommendations to the Board of Aldermen no later than the 13th day of April each year, sponsored by President Donald Kahn. President Kahn, you have the floor. Yeah, thank you. We met several weeks ago and discussed this and I think it's important for the public who might not have seen us the last time to give a brief history lesson of where we're at, how we got there. Up until the last approximately five years, the water and sewer rate setting process would be as follows. We would get an order, and there would be recommendations as to what rates we should adopt for water and sewer. Walderman had no participation or really any foreknowledge of what was going on.

▶ 40:21 The recommendation came from the city auditor and other city officials. There was no formal codification or process. It was similar to recommendations we get for example from, well actually we don't get recommendations from the assessors, but we, so we would get the recommendations and we would have to make a determination as to whether we wanted to adopt or not adopt what was proposed as rates. There was not a lot of, there was no back and forth prior to the receipt of the order And to be honest, we didn't really have a lot of real play in what went on. The administration, after the new charter was adopted, sent down this order to codify a process. And that process was to have a rate setting committee established consisting of the treasurer,

▶ 41:21 the auditor, and I believe the director of public works. At the time that that was before us, I felt very strongly that I wanted us to have more of a seat at the table, more of a role since we had to vote at the end of the day as to what the water and sewer rates were and we had to approve the budgets, I wanted to have at least one alderman participate on this committee. I made a motion, I appreciated my colleagues that you adopted the motion and amended and we included an aldermanic representative on the rate setting committee and i think i had the privilege to do that for two or three years i was followed by alderman Tramontozzi for two or three years and now alderman forbes is on there the other thing that unfolded after the formal vote

▶ 42:15 to establish this committee was that meetings of the committee were held in public minutes were kept and some level of public participation was adopted and there's been this has been disagreement as to what the appropriate level of public participation is or should be but at least we had some public participation uh starting at that point as water as water bills have climbed from maybe $100 20 years ago to a large amount per quarter now, it's become more of a contentious issue. And the genesis of the filing of this order is I feel that it's important and appropriate to have some citizen input and have citizen at the table during these deliberations. And I hope that the rest of the board concurs with me and that we adopt an order that at least includes some citizen representation on this committee.

▶ 43:25 The order I filed would not retain the treasurer as a voting member of this committee. I think I would suggest that having the auditor on the committee is probably sufficient. And there's a redundancy to have both the auditor and the treasurer as voting members. I did not include the director of the city engineer as a member of the committee. And have been taken to task by people and I think I was wrong not to include the city engineer. i would hope that as we go forward that we amend this order if it's adopted to include the city engineer the other thing that everybody needs to understand is that this is not a rate setting committee this isn't this is not a situation where you have an independent commission like i believe

▶ 44:21 lynn has a independent water and sewer commission that deals with all things water and sewer and sets rates this is an advisory committee and what this committee is mandated to do is to study the water and sewer rates and the water and sewer budgets and make recommendations to us they they don't have any formal power to make a binding vote and and respectfully relative to the speaker who i have talked with on many many occasions and have disagreed with from time to time um entities like the planning board and the board of appeals actually have the authority to make independent binding votes on on zoning matters and things of this that nature and this group this advisory committee is an advisory committee

▶ 45:15 the other committee that's similar to this in the city is the traffic commission but everybody should be aware that the traffic commission was established under a home rule petition and acts under statutory authority. So rightly or wrongly, maybe wrongly, but what we did is we, I mean collectively the Board of Aldermen, When they voted to support that legislation, power relative to certain traffic regulations and rules was ceded to the traffic commission. So I think this is apples to the traffic commission's oranges. But regardless of what anyone thinks, I can't see how it's a bad thing for us to bring citizens on board onto this committee. and i i can't help but commenting that um i didn't see the wisdom of having reserve funds

▶ 46:23 in the budget process and didn't think we should have it and was not in favor of it and maybe we will not be in favor of it next year when i make a motion not to establish uh monies in the in the ongoing budget for reserve fund but i hope that you will support this order in some form i think it's i think it's a worthwhile thing to do uh i think we can only benefit if we have citizen input in this process that's all mr chairman do you want to make an amendment to add the city engineer as one of those listed personnel uh certainly well i'll wait for the discussion okay any further discussion by um voting members um alderman's work next and then alderman Rita after alderman thank you mr chairman um i i was actually traveling on business when this order first

Zwirko: came up so i was unable to attend the meetings i did watch and also read the minutes so i wanted to first say thank you to president khan for making the motion to hold this so we could have this hearing tonight um there was also discussion at the meeting that described the benefit of having a committee either be an odd or an even number and the one thing that i would comment is i don't think that we should be um i don't think we should put too much credence into to whether or not it's an odd or even number. And I say that not only because, as President Kahn pointed out, that it's an advisory committee, but also I've found that odd number committees actually create more polarization, because

▶ 47:52 Michael P. Zwirko: if you know that you're going to have a tie vote on an even committee, it forces the group to compromise and work together in order to get a vote that will not be in a tie. When you have an odd number, generally individuals' ideologies tend to polarize themselves because they know they can get to a certain number and win the vote so when we're deliberating this evening as to how we're going to amend this order just keep in mind that you know the the end zone shouldn't be an odd or an even number the compromise the way that the committee is compromised is more important than the output of the the the totalitarian the totality of the committee's numbers so just want to put that out there for thought I would also

Zwirko: add that i do agree that we should add the city engineer the present city engineer miss proacas ellis prior to her coming here to the city of melrose did extensive work in ini mitigation and effort work in previous municipalities for which she served i think that she lends a lot of expertise in that area and i think that the as we saw from the hearings this fall and last spring excuse me last spring and last fall there is work that's going on in that area at the city level certainly more could be done but um we're doing more than we have in the past so i think that she brings something that's needed to the committee and i think the city engineer's office should be there i would support two members of the public being

Zwirko: on this advisory board i certainly would be willing to compromise with just one um putting it out there that i i see as written it seems fine obviously with the addition of the amendment to have the city engineer there i do also feel that the auditor should remain on the committee specifically because i asked a question last year during the budget process whether or not the reserve accounts as well as the enterprise funds are considered by outside rating agencies for our bond rating and our fiscal stability the answer to that was affirmative so i think that the city auditor's president's presence is important and then i just make one knit here and i'm only saying this on a technical term i don't know if it's actually needed but i noticed that the

Zwirko: amendment or excuse me the order is written only says water i don't know if it's important to put and sewer only because we actually do set water and sewer rates it might be a nit but maybe it's an important one so with that uh i i'm finished with my questions and comments mr chairman just a point of information mr chairman that that wording is from the original the original ordinance that was adopted. I think historically, when the committee's been talking, they haven't just exclusively talked about water, they've talked about sewer as well. For sure. But good point, good point. We could have further discussion. I know Alderman Wright has some comments to make. All set? All set, you're on.

▶ 50:47 Francis X. Wright Jr.: Thank you, Mr. Chairman. I also wasn't present at the last meeting. had a family matter to address but I did watch it on TV I I guess my point of view on this is that I I believe committees are more functional and and most successful when they're smaller versus larger I mean the city saw fit to reduce the size of the school committee I think that that was one of the reasons when the Charter was amended I think there's evidence to that to that extent and in various studies as relate to size of laws boards and committees I would agree that the city engineer should be part of this team this board that you know the individuals positions that we're talking about having comprised this what rates setting committee are all professionals I believe they can all

Wright Jr.: be trusted to use the good professional judgment and so I guess I would look to amend the order to substitute one resident for the city engineer to staff it with the DPW Commissioner the auditor city engineer and Alderman and one resident a question whether or not the resident should be should well the question whether it should be a resident versus citizen I don't know if there's a difference i don't know if we want to specify that i don't know if it should be a resident slash property owner or just a resident i'm comfortable with it just being a resident but obviously property owners are the ones who pay the water and sewer bills in the city also if this board is going to see fit to approve the appointment of residents or citizens on this

Wright Jr.: committee I guess I would look to have that those individuals or that individual be Appointment by this board as a whole as opposed to by the president of the board that person is coming out of this board and therefore I think we should all hope if we're going to approve this we should all have a voice voice and the selection of that person I guess I would forego making any motion at this time to the extent anyone else has any comments they would like to make I think that's that's fair and reasonable for the first time any voting members of this committee like to speak I just want a clarification for what you said so you wanted the makeup would be under your proposed amendment it would be a member of the board of aldermen a citizen the engineer and the auditor yeah through you

Tramontozzi: mr chairman the dpw commissioner the auditor the engineer and alderman and one resident okay so i missed the dpw okay thank you um out of courtesy to all members of the board of alderman i will take any discussion from non-voting members if there wish to be any and then i think what we could do is i'm going to defer back to president khan for uh suggestions on amendments if he chooses to do so then i'll open it up to others um any other any other comments or discussion any members are non-voting or voting yes sorry thank you um just again to um clarify through the chair with alderman Rita proposed amendment as if it becomes that it would include the director of public works and the city engineer to you mr chairman yes yes thank you um great that's

▶ 55:06 Mary Beth McAteer-Margolis: i think those two um are important both of them and as well as the auditor i mean i think the director of public works has the big picture view of what's happening in the department and where the funds may or may not be spent or coming from and certainly I think our current city engineer is more than qualified to and should be definitely on this I mean I think one of the reasons we are where we are is because we have had changes of staff and we have had you know certainly fabulous increases in use of technology to find out that we have had these issues and and we should address them I also am inclined to agree with Alderman Kahn the president Kahn that two citizens is not a bad idea and maybe especially if we put in the

▶ 56:05 Mary Beth McAteer-Margolis: requirement from Alderman Wright that this board is in charge you know it makes the final appointment you know we may get people from different parts of the city you know condo owners homeowners somebody who owns a true family and lives in it so I'm not afraid of having two citizens or having it be just a little bit bigger and certainly I do think this board should also be represented so I was not at the first meeting for this but I do think it's important that we review this and thank President Kahn for bringing it forward Thank you. Alderman Mortimer. My thoughts have been expressed, thank you. Great, wonderful. Any further discussions? I think we've had some good suggestions relative to possible amendments.

▶ 56:59 President Kahn, I defer back to you. Yeah, a couple of comments. As I indicated before, I agree that the city engineer should be on the committee. There's probably nobody here that disagrees with that. As to Alderman Wright point as to whether this person is designated by the President or the Board of Aldermen, I think it would be fine if the Board of Aldermen voted to approve or disapproves the name that was submitted to it by the President, perhaps. One or two citizens, at a minimum, we need one citizen. there's really no reason why we would not have some level of citizen participation on this so am i wedded to two no um i'm also mindful of the fact that this is an ordnance change and eight of us are going to have to agree with the final product so those are my thoughts and um

Zwirko: on this water rate review committee it's not a hard and fast position I'm going to take I certainly will welcome at least one so that was a little bit of my hesitation to second so I appreciate the president doing so and as I also appreciate the work of Frank Wright to make this amendment as well but the point is is I'm I would like to see two so you know we have a motion before us I i understand that so um you know i feel it'll be a win if we get out of here with one but i would appreciate two the i would that that's my discussion piece um just to kind of cross my t's and dot my eyes i would ask that an amendment to the motion that's made following the words water we place and sewer there's three instances of that in the said motion so i just asked that
