This is the legal and legislative committee of the City of Melrose Board of Aldermen. I am the chairman, Alderman John Tramontozzi, and with us this evening are voting members of this committee. alderman peter mortimer alderman scott forbes alderman michael zwerkov of course president donald khan and non-voting members present with us this evening gail inferna and monica medeiros and jennifer rummerman i think i got everybody this meeting is being recorded pursuant to the massachusetts open meeting was and would be available for a future viewing on mmtv do i have a motion to open the floor for public participation thank you alderman mortimer

Tramontozzi: moves for public participation seconded by alderman Zwirko all in favor aye aye any opposed seeing none uh this is the uh portion of the uh the committee meeting uh where any members of the public who wish to come forward and sit at the table in front of me and wish to speak on any Any matter that we have on the legal and legislative committee, Thorp only one matter on the committee agenda at the moment. So. Motion to close public participation. Mr. Chairman. Seeing no members of the public wishing to come forward to speak, we have a motion to close public participation by Alderman Mortimer, seconded by Alderman Zwirko. All in favor? Aye. Any opposed, seeing none, the public participation is closed.
▶ 1:40 John N. Tramontozzi: We have one order on the agenda this evening, and it's order number 2017-124. It's a petition to the general and great, strike that, petition to the great and general court to enact a special act, an act authorizing the city of Melrose to allow the installation of secondary water meters in two family owner occupied residential properties. This order was sponsored by the vice chairman of this committee, Alderman Francis Wright. What is the will of the committee? We do have a question that was raised by Alderman Forbes to the city solicitor who wished an opinion as to the constitutionality of it, the proposed ordinance. It's in the agenda packet, Alderman Forbes, would you like to address that and read it

I was going to just say we do have the legal response from the city solicitor, however the Water and Sewer Committee has not acted upon this order as of yet. There is a meeting tomorrow of the Water and Sewer Committee at 3.30, at which time DPW will present their financial analysis and a vote will be taken. So I would make the motion to recommit this to committee until we have a vote from the Water and Sewer Committee. It does make sense to do that. That way we'll have an opinion from them as to the financial impact of this particular order so we do have a motion to retain this order in committee and second by Alderman Forbes seconded by Alderman Mortimer on discussion any anybody have any discussion seeing none on that motion all
