▶ 8:47 Alderman Makati Margolis. Here. Here. Alderman Dearest. Alderman Mortimer. Here. Here. Alderman Tramontozzi. Here. Here. Alderman Knight. Here. Here. Alderman Zwirko. Here. Here. President Conn. Here. Here. Ten present. Okay, we have a quorum. Could everybody please rise and join me in saluting the flag. I pledge allegiance to the flag of the United States of America and to the republic for which stands one nation under god the invisible with liberty and justice for all mr president i make a motion to open the floor for public participation second alderman mortimer moves that we commence public participation the motion is seconded by alderman forbes before i call for the vote i want to remind everybody that the meeting is being recorded and will be

▶ 9:37 rebroadcast on melrose cable television on the motion to open the floor for public participation all those in favor aye anyone opposed motion passes this is the portion of our meeting where any member of the public can come forward and speak on any item which is on our agenda for this evening is there anybody who would like to come forward uh and i'll take maybe two minutes um talking regarding the petition on the sanctuary city i know there'll be an opportunity probably to speak at a later time but I wanted to just express I guess my thoughts and concerns around this issue that really in Melrose in my opinion is not an issue but in being careful that we don't divide this city and being the recipient

▶ 10:26 of a verbal chastising by others in this community when I didn't agree with or was a was on the opposite side of them it's concerning to me that we're gonna have this process where we are going to have people who are going to disagree on the sides and this is a very emotional issue for people and so I guess for me it's just I think we really need to be thoughtful on the message we give out and that this is a civil process and that people don't feel that they have the right to chastise or verbally attack or do any of that to the people that might be opposed to them so that's all I had to say thank you thank you anyone anyone else who wishes to speak this evening hi i'm jerry morose i'm here to speak on the

▶ 11:22 um composition of the water and sewer committee um a couple things from the legal and legislative meeting the other day um you know alderman khan's points you know you're correct that the zoning board the appeals board they actually make final decisions and the traffic commission as well makes final decisions and we populate a lot of citizens on those committees clearly we can trust citizens to do the right thing on the zoning board on the Planning Board on so many other committees in town without having a large contingent of city staff and employees on the committee surely if the water and sewer committee is only going to be in an advisory capacity to the Board of Aldermen I would think you can trust even more to allow citizens to be

▶ 12:12 involved in the process because if somehow you don't like what they've done you have the final say in this room here so you know I as I as I heard the conversation the other night you know it the conversation seemed to go toward from what alderman Khan has presented in his order from two members of the public there now we're down to one member of the public and what I found very strange was how that occurred at the meeting the other night a number of the aldermen said oh well you know we'd like to have at least two on the board and but but all but I'll vote for one because that's all we can get that implies two things to me either people on this board have been talking to think that there's not

▶ 12:51 support for more than one person on the on the water and sewer committee who's a member of the public to go to that and somehow you think that people aren't going to support more than one person and that's why everybody's you know notching it down to say well okay we'll vote for one which was the final vote from the Legal and Legislative Committee the other night. I find that troubling at several levels. I think that you can trust three or four citizens of Melrose to come to a Water and Sewer Committee and bring their expertises, bring their perspectives, bring their sensitivities to that committee that have been missing for many, many years in establishing policy on water and sewer in Melrose.

▶ 13:38 I don't mean to beat up on how we've gotten to the bad state we're in, where we're the worst in the MWRA, where we have the highest rates pretty much, you know, around the country, including Los Angeles and San Francisco. There's only a couple places around the country other than an MWRA that are even close to us. But we've let the power structure of the city get us to this horrible point. let the citizens have some power have some input have some some way of designing something different that citizens can contribute and support both because if you've established another water and sewer committee that is basically the existing power structure of the city declaring this is what we're going to do well guess what it's the existing power structure the city that

▶ 14:32 that's going to take all the blame spread the capacity around let the citizens be the citizens let them be have a have a role in the say of what happens in this town what's what's the fear that you have for allowing three or four citizens to be there to be in a majority on the water and sewer committee i don't understand it i would like you all tonight if you're going to vote for anybody anything less than four citizens on this committee i'd like you to express what your fears are of why you think that citizens can't contribute appropriately to a committee as you allow them and encourage them and and are proud of them doing in so many other committees around the city again what is the fear you have

▶ 15:17 um i'd like to be so bold as to suggest you know right now we have something that's recommended from legal legislative i would love it for one of the members of this board to suggest an amendment to that recommendation that we put four people there and let's let the alderman put on the record what you really think about the citizens in this community. Have a vote for four. Let's see who votes for it and who doesn't. If that fails, propose another amendment. Vote for three. If that fails, let's see who fails it and who's in favor of it and see what happens. Let's then try two. Let's try one. Let's not have any more of this dynamic around here that, oh, we're going to vote for something. We're never going to talk about why.

▶ 16:10 we're not going to give any reasons for it, we're just going to end up with a certain outcome without anything expressed publicly. The democratic process requires you to take a stand publicly. It doesn't say to you, oh well, you know, make pretend that you want a lot of citizen involvement, but oh well, there's some powers around the room that somehow obstruct you from being able to do so. Please have the courage to come out and support citizen involvement in the Water and Sewer Committee. We found over the years that not having citizen involvement has not gotten us to a good place. It's gotten us to a horrible place. And it's time to let the citizens have some input because clearly there's something missing in what we do here.

▶ 16:53 You know, I was at the school committee meeting the other night. You know, we basically have the highest athletic fees in the state, essentially. We have the highest water and sewer, you know, leaking and up there in rates in the MWRA. which is the highest the state as it is like we need something to change here and for for this board to use the same process that you've used time and again to come to the same the same conclusions that oh we can trust the power structure of the mayor with the dpw head and the city engineer and the the auditor and and and whether the treasurer or not you know it hasn't worked they've they have failed us is what's been happening here it's time to take the water and sewer issues of our city back to let the citizens have input into them

▶ 17:50 to me it frankly it was almost like a circus the last few years but water and sewer the consultancy had in their hair not even even though they paid a lot of money to supposedly bring expertise here they didn't express expertise and nobody challenged them on it if citizens were on that committee you would have found out for sure what was behind the motivation of what was presented here this whole tiered rate structure putting condos you know you know way way way higher for their water and sewer rates you know there's so many different issues at at at play here that aren't being that aren't being addressed so please again what's your fear about having citizens control the Water and Sewer Committee, which is only a committee that makes recommendations

▶ 18:40 to you. So even if you don't trust the citizens that are on there, you still have the say-so to say, okay, we don't agree, we're going to do something different. It's a recommendation. Why not let more people, a broader amount of people, a broader view of things be represented in the committee to do it? i i um i mean at some level i am challenging you please try to vote for four try to vote for three put it on the record what you really believe don't just everybody say oh well you know i'd like to have citizens there but you know it looks like the board only wants one so we're going to just vote for one i i resent that whole that whole dynamic that that that that seemed to be occurring the other night and i'd like you to reverse that tonight thank you very much thank you

▶ 19:29 Peter D. Mortimer: Yes, sir. Motion to close public participation. We need to wait to see if there's anybody else. Yeah, I took a look. Please, let's wait a second. All right. Is there anybody else in the chamber who wishes to speak on anything that's on our agenda for this evening? Motion to close public participation, Mr. President. Second. ▶ 26:27 Commission will be making its first meeting there'll be 730 p.m. on Monday March 13th in the Cassidy conference room thank you Alvin Forbes thank you mr. president next meeting for the water and sewer committee has been scheduled for Thursday March 30th at 3 30 p.m. any other committee members needing to report rule 53 if we could move to the calendar please order number 2017 dash 82 amend Melrose revised ordinances This is Chapter 228, Section 228-15B, Water Rate Review Committee, as set forth herein, amended in Legal and Legislative Committee on February 27th. This order comes from the Legal and Legislative Committee with a recommendation for passage as amended. My recollection of the amendment was that the city engineer would be a member of the committee,

▶ 27:29 the city treasurer would not. the committee recommended one citizen representative be included in the committee and there was an amendment to indicate that the citizen would be recommended by the president of the Board of Aldermen with the concurrence of the Board of Aldermen I hope I got that right if I didn't please let me know where I screwed up motion for passage second okay we've got a motion for passage by Alderman Wright seconded by Alderman Inferna and we have discussion starting with Alderman Search then moving to Alderman Tramontozzi and Alderman Inferna oh yeah Thank You mr. president as we stated in the legal legislative committee meeting last week I was in favor of it of at least two

▶ 28:13 John N. Tramontozzi: citizens as originally proposed I was a quick draw I lost I was gonna make a motion of further amend to strike one citizen for two since there's a pending motion on the floor I just wanted to make that comment I think the conversation we had on Thursday night it was a it was a fulsome one I do support the order those are all the comments I had at this time thank you yeah thank you we did have a lot of discussion at the legal and legislative committee and it's specifically on that issue of the citizens I would like to make the motion to add three citizens nominated by the president of the board of alderman confirmed by the uh the board of aldermen and um i would make that motion at this time second alderman chairman tozy is moving to amend the order that's before the floor to

▶ 29:07 Gail Infurna: increase the citizen representation from one to three is there's there's a second second alderman Medeiros seconds that motion further discussion go ahead i i was under the impression with a motion on the floor another motion couldn't be forwarded yeah we'll call the vote on the current motion before the board before we entertain votes on subsequent motions Alden Ferney you have the floor right thank you very much mr. president yes we did have good discussion last week on this and listening to mr. Moroz this evening I just want to make it a point to say that this is not an issue of trust here I think it's really an issue of working efficiently getting the work efficiently done it's not that we

▶ 29:59 Gail Infurna: don't trust or at least I personally don't trust the public to make you know to be on this board but we have to work efficiently and the more people you have the more inefficient committee becomes we have an alderman on the on that board on that committee that if anybody in the public has any concerns any thoughts or anything they can go to the ultimate aldermanic representative on that so I I think we have to keep in mind that this is not town government. We do government by representation, and so I'm going to support the original order on this, and we must keep that in mind. It's really not a matter of trust, it's efficiency, and this is not town government. Okay, I have Alderman Wright, then Alderman McAteer-Margolis.

▶ 30:49 Francis X. Wright Jr.: Thank you, Mr. President. I agree with Alderman Inferna, I too trust the members of the public, but the people who are part of this committee who work here in City Hall work day in and day out on the issues that they're facing, whether they be water, sewer, or fiscal. Bringing the viewpoint of a citizen on board is great. As a matter of fact, other residents of the city are always welcome to attend these meetings, when I've been there they've been allowed to speak so they're they're made cognizant of what's on the agenda they have access to the materials and they can be present and speak so they don't necessarily have to feel like they're part of the board itself and committed to attend meetings as all the

▶ 31:37 Francis X. Wright Jr.: Miniferno points out these meetings tend to happen during the day so I think you're limiting the scope of a board when you have have one that's dependent mainly on full-time employees of the city who you know have family and lives of their own and will meet during the day so you're going to bring in people who retirees or otherwise perhaps they have to find time to try to attend meetings on a very important subject which is the water and sewer rates of the city so for that reason I support having an alderman and the resident be part of the committee keeping the member the meetings open to the public which is required by state law and allowing public participation thank you thank you mr. president I was not I am NOT a member of the legal and legislative so I

▶ 32:37 Mary Beth McAteer-Margolis: was unable to vote on this last week but I did indicate that I felt it would be good to have two people on the board I think that three my in my opinion might be a little bit more than necessary the reason I'm looking for two is because I think we can have at the president's discretion someone representing a more traditional homeowner and then perhaps somebody representing multi-families or condominiums I do agree with alderman Rita that we do need our professionals on this they're able to look at the big picture and see the financial and the fiscal ramifications of setting the rate i do think it's important obviously that we need um an aldermanic representative and that we continue to have those meetings open to the public as they have been and

▶ 33:28 Mary Beth McAteer-Margolis: the ones i've attended there generally have been several members of the public there and they have also been allowed to speak at this time i'm not going to make a motion to amend because i know already have one motion to amend but um but as i say i should that motion not pass i would be in favor of amending to make it two citizens thank you procedurally we do have a motion that's been made and seconded to recommend which would have to go forward before other motions could be entertained for a vote so unless there was a withdrawal of the motion to recommend um we'd have to deal with that motion first thank you for the discussion just a point of order motion recommend requires eight votes is that correct a motion to change ordinance requires eight votes

▶ 34:13 this is a motion to change ordinance which would require eight concurring votes is there further discussion associate could you call the role please is this on the amendment uh the order has amended has been a motion to recommend has been made and duly seconded problem brazil excuse me we're working on the motion that mr alderman charmentozzi no no we are not we are working on a motion that was made uh to recommend the order as amended from committee and has been seconded okay yes alderman forbes yes yes alderman inferno yes yes alderman yes yes alderman mcateen no no arlen maderas uh pardon me this is to accept the committee amendment yeah this is on the on the order as a matter and it's it could certainly be amended after this

▶ 35:13 is that no this is a vote on the order as amended up or down no no yes yes no no all of them right yes yes no no president khan yes yes okay the order fails seven thanks mr president I make a motion to adopt the proposed amendment as initially amended in the Legal and Legislative Committee, but with the further amendment of three citizens nominated by the President of the Board of Aldermen. On a point of order. Yes. We've had a final vote on the order, and it's not subject to further amendment unless that vote is reconsidered. So motion for reconsideration. Motion for reconsideration. Second. only be made by somebody who was on the prevailing side. Alderman Medeiros, you're moving for reconsideration

▶ 36:20 of the vote? Yes. Is there a second? Second. Seconded by Alderman McAteer-Margolis. All those in favor of reconsideration of the vote, please indicate by saying aye. Aye. All those opposed? Opposed. Can I see a show of hands on the opposed, please? Okay, the motion for reconsideration fails and the order fails Alderman McAteer-Margolis Mr. President I would move to put forward a new order well in order to put forward a new order it would have to be docketed and placed on the calendar so to amend this we can't amend the order you can take no further act it's the ruling of the chair that we can take no further action on this order this evening it has failed fair enough if we could move on please order number 2017-106 a transfer
