▶ 2:02:19 Shawn M. MacMaster: Seeing none, this order is before us. Thank you, Madam President. This order is an easement request that I have filed on behalf of Jim and Dana Wilson who live Ward 5 at 9 Brown Street. For those unfamiliar with what an easement is, it's a legal request for permission to use land owned by someone else. In this case, the Wilsons are seeking relief from the city to repair a large 100-year-old retaining wall that collapsed on New Year's Eve and landed on the sidewalk there on brown street when mr and mrs wilson had the property surveyed before rebuilding out of an abundance of caution they learned that the wall again which had been built more than 100 years ago is inside city property despite this the wall does not interfere with the sidewalk or pose any sort of obstacles to pedestrians when it's intact i would also attest that the wall does not interfere in any way with the butters as there are only five homes on the street and the property is somewhat isolated the wall also connects to a garage as well so the the garage is a stone wall that connects to um to the wall and uh essentially that's a garage that they use for their vehicle so it's not just a matter of having a retaining wall, it's also in part necessary in order for the use of that garage and the structural integrity that is needed in order to park there and the safety that's related to that. I would note that the administration is in support of this order. If this asked that is granted through the mayor and attested by this council as the ward counselor, I'm asking that it be approved. Mr. and Mrs Wilson have been eagerly trying to get the surveying work done, which they've been doing now for multiple months in order to make the repairs, which they can't legally make or they they could. could but then they would certainly be encroaching on city property there could be certain legal consequences for that as we consider this i just did also want to acknowledge the city solicitor uh mr van campen as well as director of public works miss paracas ellis both of whom did an incredible amount of leg work on this and uh who uh worked uh with the nilsons and with me uh in order to gather all the information needed to come before you tonight uh a type of work i think as Consular Tramontozzi knows is significant and we wouldn't be able to get where we are today without the work of Mr. Van Campen and Ms. Paracas-Ellis so at this time Madam President I would make a motion for passage of this order second that motion okay we have a motion for
